Slip up near salad bar leads to suit against Schnucks

Erica Wilson has filed suit against Schnuck Markets, Inc., alleging her neck, shoulder and low back were injured after she slipped on standing water in the grocery store.

Wilson was visiting the store Nov. 6 and was walking near a refrigerator adjacent to a salad bar when she slipped on the water, which caused her to fall, according to the complaint filed Dec. 19 in St. Clair County Circuit Court.

In addition to her injuries, Wilson incurred medical expenses, suffered disability, experienced pain and suffering and lost money from the loss of wage, the suit states.

Schnuck Markets was negligent by failing to provide a good, safe and proper place for Wilson to walk, by failing to have a safe procedure for cleaning and removing water from the floor and by failing to place warning signs, Wilson claims.

It also negligently managed its store in such a manner to allow water to accumulate and stand in an area where customers normally walk, allowed the premises to become and remain in an unsafe, defective and dangerous condition, failed to manage, inspect, clean and maintain the premises and failed to maintain its refrigeration equipment in good working order, according to the complaint.

Wilson is seeking a judgment in excess of $50,000, plus costs.

Thomas C. Rich and Jennifer L. Barbieri will be representing her.

St. Clair County Circuit Court case number: 08-L-647.
