Driver claims he was rear-ended on Carlyle Avenue

Herbert Lush has filed suit against Wanda Patterson, alleging he was seriously injured after an accident.

Lush was driving east on Carlyle Avenue on Aug. 12, 2007, when Patterson, who was driving behind Lush, rear-ended him, according to the complaint filed Dec. 15 in St. Clair County Circuit Court.

Because of the accident, Lush suffered severe and permanent injuries to his back and body and great bodily pain, the suit states.

Lush also claims he lost his normal life and incurred significant medical expenses.

Patterson was negligent by failing to keep her vehicle under control, by failing to keep a proper lookout, by failing to reduce her speed, by failing to apply her brakes, by driving too fast and by driving too close to the vehicle in front of her, according to the complaint.

Lush is seeking a judgment in excess of $50,000, plus costs.

He is represented by Kenneth P. Danzineger of Callis, Papa, Hale, Szewczyk and Danzinger in Granite City.
