Donzo's Lounge named in Dram Shop suit

Anthony W. Jones has filed suit against Donzo's Lounge, alleging he was injured after a collision with a drunken driver who had purchased alcoholic beverages at the bar.

Jones was driving his 2002 Pontiac north on East Alton Avenue near its intersection with East St. Louis Avenue in East Alton on Dec. 15, 2007, when Laura Magac collided with him, according to the complaint filed Dec. 15 in Madison County Circuit Court.

Magac was intoxicated at the time of the collision because of drinks she had purchased at Donzo's Lounge, the suit states.

Because of the collision, Jones was made sick, sore, lame and disordered, suffered extensive injuries to his back and experienced pain and suffering, the suit states.

Jones claims he also incurred medical expenses and suffered a loss of earning capacity, lost wages, disability and disfigurement.

Donzo's Lounge breached its duty to protect the public from harm by allowing Magac to ingest alcoholic beverages to the point where she was legally intoxicated.

In the two-count suit, Jones is seeking unspecified damages, plus a judgment in excess of $15,000 but not more than $50,000, costs and other relief the court deems just.

He is representing himself.

Madison County Circuit Court case number: 08-L-1176.
