Mitchelle Price has filed suit against the village of East Alton, Alton Shopping Center and Subway Enterprises, alleging she was hurt after slipping on ice that had accumulated outside a Subway restaurant.
Price was walking on the sidewalk outside the Subway located at 612 Berkshire Boulevard in the Wilshire Plaza in East Alton on Dec. 17, 2007, when she stepped on ice, causing her to fall, according to the complaint filed Dec. 15 in Madison County Circuit Court.
"Under information and belief, Defendant changed the natural flow of water such that it caused water to accumulate," the suit states. "This standing water turned to ice with the falling temperature."
Because of her fall, Price's various muscles, ligaments, membranes, nerves, blood vessels and tissues were sprained, torn, cut or bruised and she became sick, sore, lame and disordered, she claims.
Price has also suffered great pain and anguish, injuries to her back, internal derangement of the injured members of her body and incurred medical expenses, according to the complaint.
She claims East Alton, Alton Shopping Center and Subway Enterprises were negligent by failing to exercise reasonable and ordinary care in maintaining their sidewalk, by failing to warn Price of the dangerous conditions on the sidewalk and by failing to warn Price of any hazardous or unreasonably dangerous conditions on the property, the suit states.
In the three-count suit, Price is seeking a judgment in excess of $150,000, plus costs.
