Fairmont City accident is subject of suit

Ketura and David Rothe have filed a suit against Octavio Re-Reza, alleging they were seriously injured after he collided with the vehicle in which they were riding.

The Rothes were traveling south on Kings Highway near its intersection with Maryland Avenue in Fairmont City on Sept. 20 at about 6:40 p.m. when Re-Reza, who was driving his Ford north near the same intersection, collided with them, according to the complaint filed Dec. 3 in St. Clair County Circuit Court.

Because of the accident, the Rothes were injured internally and externally, sustained fractures, sprains and strains and were injured to they could not perform their regular employment, the suit states.

In addition, the couple claims they have suffered a loss of their ability to enjoy a normal life, suffered disfigurement, experienced pain and suffering and incurred medical costs.

The Rothes' vehicle was damaged beyond repair, according to the complaint.

Re-Reza was negligent because he made a left turn in front of an oncoming vehicle, failed to abide by the commands of the traffic signals, drove while intoxicated, failed to keep a proper lookout and drove faster than reasonable, according to the complaint.

In the three-count suit, the Rothes are seeking a judgment in excess of $100,000, plus costs and a fair and just award for the value of the vehicle plus prejudgment interest.

They are represented by Jerald J. Bonifield of Bonifield and Rosenstengel in Belleville.
