New Athens nursing home sued over resident's injuries

An attorney-in-fact has filed a suit New Athens Home for the Aged on behalf of one of the nursing home's residents, alleging the resident fractured her left leg, right leg and dislocated her right shoulder because of the home's neglect.

Gregory Krieg claims Margaret Krieg sustained the injuries on March 3 and on June 7, according to the complaint filed Nov. 26 in St. Clair County Circuit Court.

While at the home, Margaret suffered severe and repeated pain, mental anguish and distress, the suit states.

In addition, she has become further debilitated and disabled and has incurred great medical expenses, Gregory claims.

Margaret's ability to participate in ordinary activities and to enjoy life have been adversely affected, according to the complaint.

She developed her injuries because the nursing home violated multiple provisions in "The Nursing Home Care Act," the suit states.

The violations include the nursing home's failure to evaluate Margaret to ensure she received adequate supervision and assistance to prevent accidents, its failure to assess the risks associated with side rails, its failure to appropriately update Margaret's care plan to address her history of falling and its failure to identify potential risk factors, Gregory claims.

Gregory is seeking a judgment in excess of $50,000, plus attorneys' fees and costs.
