Man claims severe injuries from I-64 accident

A St. Clair County man has filed suit against a Madison County man and a trucking company, claiming his head, neck, back, right shoulder and left leg were severely injured after a collision.

Daniel Jones claims he was driving west on I-64 in St. Clair County on Feb. 19, 2007, when David Wagstaff "violently struck" his vehicle, according to a complaint filed Oct. 8 in St. Clair County Circuit Court.

Wagstaff was working for Brink Brothers Grain and Trucking at the time of the accident, according to the complaint.

In addition to his injuries, Jones was hindered and prevented from attending to his usual duties and has lost large sums of money, the suit states.

Jones claims he has also suffered great pain and physical and mental anguish and has incurred substantial medical costs.

Wagstaff was negligent because he failed to keep a proper lookout, failed to observe Jones, failed to keep his vehicle under proper control, failed to apply his brakes and failed to decrease his speed or to turn to avoid colliding with Jones, according to the complaint.

In addition, Wagstaff negligently failed to give proper warning and drove too closely to Jones, the suit states.

In the two-count suit, Jones is seeking a judgment in excess of $50,000, plus costs.
