Pest company sued by woman injured in accident

Sarah E. Jones has filed suit against Bush Pest Control and one of its employees, alleging her neck, back and right arm were injured in a rear-end collision.

Jones was driving west on Homer Adams Parkway near its intersection with Buckmaster Road on Oct. 20, 2006, at about 11:20 a.m., according to the complaint filed Oct. 17 in Madison County Circuit Court.

Jarvis T. Swope was operating a vehicle for Bush Pest Control at the same time, and collided into the rear of a vehicle driving behind Jones's, "causing a chain reaction pushing another vehicle into the rear of Plaintiff's vehicle," the suit states.

In addition to her injuries, Jones claims she paid substantial medical expenses and suffered lost wages, pain and disability.

She claims Swope was negligent because he failed to keep a proper lookout, failed to decrease his speed to avoid a collision, drove too fast and failed to maintain control of the vehicle he was driving.

Bush Pest Control was negligent because Swope was one of its employees, according to the suit.

In the two-count suit, Jones is seeking unspecified damages and costs.

Steve Selby and Laura A. Cole of Smith, Mendenhall and Selby will be representing her.

Madison County Circuit Court case number: 08-L-978.
