Rib fractures claimed in auto accident

Melvin Kimbrell has filed suit against Kary Brown and Koetter Woodworking, claiming he sustained multiple rib fractures after Brown's vehicle struck him.

Brown was driving north on North Greenmount Road on Oct. 30, 2006, when the incident occurred, according to the complaint filed Oct. 16 in St. Clair County Circuit Court.

He was working for Koetter Woodworking at the time of the accident, the suit states.

In addition to his fractured ribs, Kimbrell suffered severe and permanent injuries to his neck, back and body, the suit states.

Kimbrell claims that because of his injuries, he is hindered and prevented from his usual duties and has lost large amounts of money.

He also has suffered great mental and physical pain, suffering and anguish and has spent a significant amount on medical expenses, according to the complaint.

Brown was negligent because he failed to keep a proper lookout, failed to observe Brown, failed to keep his vehicle under control, failed to apply his brakes, failed to decrease his speed to avoid hitting Brown, failed to turn his vehicle, failed to give proper warning and drove too close to Brown, the suit states.

In the two-count suit, Kimbrell is seeking a judgment in excess of $50,000, plus costs.
