Country Preferred Insurance Company has filed suit against FedEx Freight in an attempt to recoup money it paid out for an auto accident.
Country alleges one of their policy holders, Heather Starkey, was injured on May 1, 2007, when a FedEx truck driven by Larry LaRock collided with her on Interstate 55/70 near mile marker 18 in Troy.
According to Country, LaRock was operating a 2006 Volvo tractor trailer when he allegedly improperly attempted to merge into the left lane from the right lane causing another motorist to swerve to avoid a collision, cross the median and collide with the front end of Starkey's vehicle.
Country claims LaRock negligently and carelessly failed to keep his vehicle under proper control, failed to keep a proper lookout, drove his vehicle in a manner that was not reasonably proper under the circumstances, drove at a speed greater than reasonable and attempted to change lanes without signaling.
Represented by Trenton Galetti of Edwardsville, Country alleges Starkey's vehicle was a total loss causing them to pay her $17,614.49.
In addition, the insurance company alleges Starkey sought medical expenses for injuries she sustained as a result of the accident causing them to pay $5,000 in medical expenses.
Country is seeking a judgment of $22,614.49, plus costs of the suit.
The case is awaiting mandatory arbitration.
