Schantz & Sons of Highland is suing a customer for failing to finish paying for a custom designed trailer.
According to a suit filed Oct. 3 in Madison County Circuit Court, Schantz & Sons claims Mary Ellen Blash of Fontana, Calif. ordered a custom trailer costing $185,591.93 in July 2006, but has only paid $35,000 to date.
"That the Plaintiff has now substantially performed the work, and designed and constructed the custom designed trailer in Madison County, Illinois, per the request of the Defendant, but has been recently advised by the Defendant that she will not pay for the custom trailer," the complaint states.
"…Plaintiff is still rightfully owed significant monies for its work completed to date, plus interest on all past due amounts, under the oral contract."
Schantz & Sons claims that Blash made two payments for the trailer; $20,000 on July 27, 2006, and $15,000 on Nov. 26, 2007.
