Tim Petterson has filed a suit on behalf of his daughter against Jason Rust, alleging her face and nose were injured after Rust collided with the vehicle in which she was riding.
Riley Petterson was a passenger in a vehicle traveling west on West State Street near its intersection with Willow Drive in O'Fallon while her mother, Carla, was driving on Sept. 3 at 2:05 p.m., according to the complaint filed Oct. 3 in St. Clair County Circuit Court.
At the same time, Rust was driving his 2000 Chevy S-10 pickup truck east on West State Street near the same intersection and made a left turn across the Petterson's path, colliding with their vehicle, the suit states.
As a result of the accident, Riley claims her face and nose were injured and she has been hindered and prevented from attending to her normal duties.
She and her family have also had to pay a substantial amount for medical expenses, according to the complaint.
Rust was negligent because he failed to yield the right of way, the suit states.
In the two-count suit, Riley and Tim are seeking a judgment in excess of $35,000, plus costs.
They are represented by Donald W. Urban of Sprague & Urban in Belleville.
