A man who tripped and fell face first on a piece of plywood at the Alton Lowe's Home Center has settled his personal injury lawsuit for an undisclosed amount.
Thomas Allred claims he was shopping for plumbing supplies Sept. 14, 2007, when walking near the lumber area he tripped and fell on a piece of plywood that was lying on the floor.
Madison County Circuit Judge David Hylla signed off on the settlement Oct. 2.
Allred filed the suit on Aug. 12. He was represented by Michael Glisson of Alton.
Allred had alleged Lowe's was negligent by failing to have routine and proper inspections, allowing the plywood to remain on the floor in an area customers were directed to walk, failing to restock the plywood and failing to warn that the plywood was on the floor.
He had claimed the fall caused injuries to his neck, low back and other areas of his body which caused and continue to cause pain and suffering, medical expenses and lost wages.
Allred was seeking damages of at least $50,000.
