Breach suit filed over unpaid commercial building work

An Illinois company has filed a breach of contract complaint against a Missouri company, alleging it failed to pay for services it performed.

Represented by Dennis J. Orsey of Granite City, Ellinger Winfield claims The Robert Kaplan Trust agreed to pay Ellinger Winfield for work on the interior of a commercial building, but has refused to pay all the money due.

"To date, Defendant has paid to Plaintiff the total sum of $234,615 and refuses to pay to the Plaintiff the remaining monies due in the amount $78,207," the complaint filed Oct. 1 in Madison County Circuit Court states.

Ellinger Winfield claims it is also owed 5 percent interest on money it is due.

Ellinger Winfield is seeking a sum in excess of $50,000, plus prejudgment interest, attorneys' fees, costs of the suit and other relief the court deems just.
