Woman sues New China over car accident

Michelle Fenwick has filed a personal injury complaint against New China restaurant and its delivery driver Cai Wen Wu, alleging she was injured in a traffic accident.

Fenwick alleges she was driving southbound on Illinois Route 111 in Bethalto on Dec. 9, 2006, when Wu collided with her where Route 111 intersects with Bender Avenue.

According to the complaint filed Aug. 15 in Madison County Circuit Court, Wu failed to make a stop at a posted stop sign.

Fenwick alleges Wu was negligent by failing to slow down to avoid an accident, failing to stop for a stop sign, failing to yield and failing to look both ways before entering the intersection.

She claims New China was negligent by failing to adequately supervise, instruct and hire a competent driver.

Fenwick claims the collision caused and continues to cause pain and suffering, loss of a normal life, lost wages and medical expenses.

She is seeking a judgment in excess of $100,000, plus costs.

Thomas Falb of Williamson, Webster, Falb & Glisson in Alton represents Fenwick.

The case has been assigned to Circuit Court Judge Barbara Crowder.
