Nursing home resident sues over gangrene

A resident of the Calvin Johnson Care Center in Belleville is suing the nursing home's corporate owner, Eldercare, Inc., claiming he sustained injuries that required the removal of his left testicle.

In a lawsuit filed Aug. 15 in St. Clair County Circuit Court, Fred Moss claims the defendant is negligent for violating the Nursing Home Care Act during a period between Oct. 1, 2006 and Nov. 8, 2006.

He claims he sustained injuries "including but not limited to cellulitis to his scrotum and penis and gangrene in his penis," the complaint states.

Moss is represented by attorney Staci Yandle of Belleville.

"…Fred Moss has suffered and continues to suffer severe and repeated pain and suffering, mental anguish and emotional distress and has become further debilitated and disabled…," the complaint states, "and plaintiff's opportunity to participate in ordinary activities and ability to enjoy life have been adversely affected…"

The suit names Dr. Basga Bernard as a respondent in discovery "because plaintiff believes he has information essential to the determination of who should properly be named as additional defendants in this case."
