Sears customer claims stove was defective

Donald Weeks has filed a breach of contract suit against Sears, alleging a gas ranged stove he purchased had defects.

He claims Sears refused to repair or replace the stove despite the fact he purchased an extended warranty, according to a suit filed in Madison County Circuit Court on July 30.

Weeks purchased the stove and an extended warranty on Dec. 22, 2005, the complaint states.

"Plaintiff Don Weeks has made repeated demands on Defendant, Sears, Roebuck and Co., to either repair, replace, or give Plaintiff, Don Weeks, a refund for the aforementioned stove," the complaint states.

Weeks claims the alleged breach has caused him to sustain substantial property damage and economic hardship.

He is seeking a judgment in excess of $15,000 but less than $20,000.

Weeks is represented by H. Carl Runge, Jr., of Collinsville.

The case is awaiting mandatory arbitration.
