Wrongful death complaint filed against Odesco Industrial Services

Patrick and Linda McMahon of St. Louis has filed a wrongful death suit against Odesco Industrial Services, seeking damages for their son's death.

According to the complaint filed Aug. 5 in Madison County Circuit Court, Michael McMahon was killed in an automobile accident Feb. 9, in St. Louis County.

The McMahons allege Michael was a passenger in a vehicle driven by Samuel Rachas when a truck driven by co-defendant Matthew Yon struck the vehicle at the intersection of Telegraph Road and Erb.

They claim the vehicle Yon was driving was owned by the South Roxana-based Odesco Industrial Services.

"The collision between the Odesco industrial truck and the Rachas vehicle which took the life of Michael McMahon was the direct and proximate result of the negligence of Defendants in that Defendants operated their vehicle at an excessive speed, failed to keep a proper lookout, allowed and permitted their vehicle to strike the Rachas vehicle in the rear and was following the Rachas vehicle too closely," the complaint states.

The McMahons are seeking a judgment under the Missouri Wrongful Death Statute in excess of $50,000, plus costs.

They are represented by Troy Walton of The Rex Carr Law Firm and Gary Growe of St. Louis.

The case has been assigned to Circuit Judge Barbara Crowder.
