Hole in McDonald's parking lot caused injuries, woman claims

McDonald's

A woman who tripped in a McDonald's parking lot on pavement used for the drive-through is suing the restaurant owner for damages in excess of $50,000.

Linda McCleery claims she tripped and fell with "great force and violence" on her way inside the Swansea restaurant, located at 2605 N. Illinois St., on June 19, 2007, according to a complaint filed Aug. 1 in St. Clair County Circuit Court.

McCleery claims she tripped on a hole in the parking lot, suffering injuries to her left wrist, knees, chest and other areas of her body.

She claims that defendant CLJC, Inc. is negligent for failing to maintain its parking lot, among other things.

"That Plaintiff Linda McCleery was invited as a customer of said McDonald's Restaurant," the complaint states.

"The Plaintiff did not misuse the premises in any way."

McCleery is represented by Michael P. Glisson of Williamson, Webster, Falb & Glisson of Alton.
