A customer of Factory Card & Party Outlet hit her shoulder after walking into a door, according to a personal injury suit filed May 14 in St. Clair County Circuit Court.
Seeking in excess of $50,000, but less than $75,000, Dorothy Panepinto claims the store should have known the door was not reasonably safe for persons to use it because it was missing a safety bar.
The incident took place May 24, 2006, although the complaint does not indicate the store's location. There is a Factory Card Outlet store in Fairview Heights.
Panepinto is represented by John Driscoll of St. Louis.
She injured her rotator cuff, elbows, neck and back, the complaint states.
"That Defendant failed and omitted to rope off, barricade, or otherwise provide notice of the dangerous condition the door posed without the manufacturer equipped safety bar which would prevent persons from using said door," the complaint states.
