Man run over and dragged by car sues driver for reversing without warning

Donald Farris, Jr., filed a personal injury complaint against Steven Jones in Madison County Circuit Court May 2, alleging Jones intentionally ran him over with his car.

Farris claims he was standing at the driver's side door of Jones' 2004 Ford Escort on May 4, 2006, when Jones placed the vehicle in reverse striking him with the door and knocking him to the ground.

Farris claims Jones backed over his body with the front of the vehicle.

"Farris' body was then run over by the rear tire and drug for a short distance underneath the vehicle at which time Jones fled the scene after Farris' body dislodged from underneath the vehicle," the complaint states.

According to the complaint, the incident occurred at 1332 Leland St., Lot 6 in Collinsville.

Farris claims he received several injuries to his upper torso and arms including abrasions on his side, right forearm, right elbow area and left shoulder in addition to abrasions on his left thigh and left side of his head.

He claims Jones breached his duty of care and was negligent in the following ways:

  • Operating the vehicle in a manner to cause severe injury;

  • Recklessly operating the vehicle to cause severe injury;

  • Driving at excessive speeds under the conditions;

  • Reversing the vehicle without warning;

  • Fleeing the scene of the accident causing substantial injuries; and

  • Violating the laws of Illinois which govern drivers.

    Farris claims his various injuries have caused and will continue to cause him pain, discomfort, mental anguish, medical expenses and lost wages.

    Represented by Justin Whitton of Whitton Group, P.C., in Clayton, Mo., Farris is seeking damages in excess of $50,000, plus costs.

    The case has been assigned to Circuit Judge Dan Stack.
