Godfrey lawyer sues Freed & Weiss for not paying litigation fees

A local lawyer filed a breach of contract complaint against Chicago law firm Freed & Weiss in Madison County Circuit Court, alleging the law firm has refused to pay him legal fees.

Paul Weiss is named as co-defendant, according to the suit filed April 30.

Timothy Campbell of Godfrey claims Weiss agreed with him to represent a mutual client in civil litigation pending in Madison County and to divide the fees recovered from the litigation.

Campbell claims he has performed all obligations required of him in representing the client, and has earned legal fees for the representation.

According to Campbell, Freed & Weiss has collected funds from the litigation, part of which covers fees due to him for his representation of the client but Freed & Weiss has refused payment, breaching contract.

He claims potential witnesses, Richard Burke and Paul Weiss, have knowledge regarding the circumstances of his representation.

Campbell also claims Weiss and the law firm have converted funds that belong to him.

Represented by John Hoefert, Jr. of Godfrey, Campbell is seeking compensatory damages in excess of $200,00 and punitive damages in excess of $100,000.

The case has been assigned to Circuit Judge Daniel Stack.
