Amendment to Structural Work Act bill passes in committee

The Illinois House Judiciary Committee (Civil Law) has passed an amendment that exempts architects, land surveyors and structural engineers in a piece of legislation that re-establishes the Structural Work Act.

An amendment to House Bill 2094, proposed by the bill's sponsor, Rep. John Fritchey (D-Chicago), passed in committee this morning along party lines, 8-5.

The measure is backed by the Illinois Trial Lawyers Association.

Rep. Jay Hoffman (D-Collinsville) serves on the committee and voted in favor of the amendment.

Re-introduced last month as the Construction Safety Act of 2008, the amended version of HB2094 would re-establish the Structural Work Act (SWA), which was repealed more than 13 years ago in Illinois. The legislation would allow injured workers to sue third parties over workplace accidents.
