O'Fallon man claims brothers conspired to assault him

Jeffrey A. Cantrell of O'Fallon is suing brothers Ryan Weslee Borkowski and Thomas Brian Borkowski of O'Fallon for an assault that took place July 17, 2007 at 416 Dartmouth Dr. in O'Fallon.

According to a complaint filed April 22 in St. Clair County Circuit Court, Cantrell sustained severe and permanent injuries to his head, including a fractured jaw which required surgery, after Ryan Borkowski "wrongfully struck him with his fist on or about plaintiff's head and face."

Cantrell claims that Ryan Borkowski had an agreement with Thomas Borkowski, pursuant to a civil conspiracy, to commit assault and battery on him.

"That the assault and battery was done pursuant to and in furtherance of the common scheme between defendant, Thomas Brian Borkowski, and his brother, Ryan Weslee Borkowski, to injure the plaintiff," the complaint states.

Seeking in excess of $150,000 in damages plus costs of the suit, Cantrell is represented by Michael P. Murphy of Freeark, Harvey, Mendillo, Dennis, Wuller, Cain & Murphy of Belleville.
