A Highland man filed a Dram Shop complaint against The Cellar alleging a patron assaulted him as a result of his intoxication.
Ken Childerson claims that on April 17, 2007, he was a patron at The Cellar conducting himself in an "inoffensive and orderly manner" when co-defendant Lonis Kircher, without provocation, violently attacked him by striking him in the face with his fists, causing him to fall to the floor.
The Cellar is located at 1222 Broadway in Highland.
Childerson claims that prior to the alleged assault, The Cellar sold or gifted alcoholic beverages to Kircher who became intoxicated.
Represented by Van-Lear P. Eckert of Belleville, Childerson filed suit in Madison County Circuit Court April 16.
He claims the assault caused him to sustain significant and serious injuries to his back, legs, hips and other internal and external organs that caused him to incur medical expenses, experience pain and suffering and loss of a normal life.
Childerson is seeking damages in excess of $150,000, plus costs.
The case has been assigned to Circuit Judge Dan Stack.
