Luna Cafe employee allegedly hits patron on head with beer bottle

Donna Dioneda filed a dram shop complaint against the Luna Cafe in Madison County Circuit Court April 8, alleging she was assaulted by a drunken patron.

Dioneda claims she was at the Luna Cafe on April 28, 2007, when co-defendant Trish Bickell, a Luna Cafe employee, assaulted her by hitting her in the head with a beer bottle.

According to Dioneda, Bickell was consuming alcoholic beverages prior to assaulting her.

She claims Luna Cafe was negligent in hiring Bickell because of her violent propensities.

Dioneda claims that as a result of the assault, she sustained injuries to her head, medical expenses, disability and pain and suffering.

She is seeking damages in excess of $200,000, and is represented by Laura Cole of Alton.

On April 7, Luna Cafe was named in another dram shop complaint.

In that case, Lisa Payne claims she and her minor son were injured when William Wallace collided with them on Old Alton Road in Granite City.

Payne alleges Wallace was drinking at Luna Cafe prior to the Oct. 6, 2007 collision.

Represented by Brian Polinske of Edwardsville, Payne is seeking damages in excess of $100,000, plus costs.

Payne's case has been assigned to Circuit Judge Barbara Crowder.

Circuit Judge Dan Stack has been assigned to the Dioneda case.
