Rodney Painter of Caseyville filed a Federal Employers' Liability Act suit against his employer Alton & Southern Railway Co. claiming grievous injuries from a work place accident April 5, 2005.
Painter, a conductor helper, claims he was coupling a loaded hopper car to a locomotive in the East St. Louis rail yard when he hurt his neck and back.
He claims he has incurred medical expenses and lost wages. He also claims his future earning capacity has been substantially reduced.
According to the suit filed April 4 in St. Clair County Circuit Court, Alton & Southern Railway is negligent for failing to provide him with a reasonably safe place to work, among other things.
Represented by John T. Papa of Callis, Papa, Hale, Szewczyk, Rongey & Danzinger of Granite City, Painter is seeking in excess of $50,000 in damages.
