Cheese distraction contributes to woman's injuries at Wal-Mart

Margaret Wienstroer is suing the O'Fallon Wal-Mart for neck and back injuries after slipping on water while attempting to get cheese from a refrigerated display case.

Wienstroer claims the store is negligent for allowing clear liquid to remain on the foor when it knew that it would cause injury, according to a suit filed April 3 in St. Clair County Circuit Court.

The incident took place at approximately 1 p.m. on Aug. 27, 2007, the complaint states.

"The defect of water or clear liquid was not open and obvious, and if it was the Plaintiff, Margaret Wienstroer, was distracted by the display of cheese and dairy products displayed in the refrigerated display case," the complaint states.

Seeking in excess of $50,000, but less than $75,000, Wienstroer is represented by Paul M. Storment of Belleville.

She also claims the store is negligent for failing to mop up the water, failing to place warning cones near the area of the water and failing to monitor the aisle ways.
