Alton restaurant breached contract, suit claims

Operators of Copley's 9th Street Restaurant in Alton are being sued by the owner of the premises for failure to pay rent.

Safeland, Inc. filed suit March 24 in Madison County Circuit Court seeking $134,000 plus costs and attorney's fees from Cardinal Acres, Inc., Joel Copley and Catherine Dondanville.

Safeland claims the defendants breached a Jan. 9, 2003, contract by failing to pay rent, failing to pay a pro-rata share of taxes, insurance and maintenance, failing to maintain the premises and failing to pay water and sewer costs.

"Defendants have caused Plaintiff to resort to litigation and incur costs and attorneys fees...," the complaint states.

Safeland is represented by John H. Leskera of the Leskera Law Firm in Collinsville.
