A woman who was injured while working at the Spring Garden Family Restaurant in Collinsville filed suit in Madison County Circuit Court March 20, alleging her employer failed to provide workers' compensation coverage.
Shelia Lopez claims she injured her back on Aug. 26, 2007, when she slipped and fell while performing her duties.
Lopez claims the owner, Feto Jusufi, failed to provide workers' compensation coverage for her benefit in violation of 820 ILCS 305.
In Illinois, employers are required to carry some form of workers' compensation coverage in case an employee sustains an on the job injury.
"Proof of the plaintiff's injury constitutes prima facie evidence of negligence on the part of Defendant employer," the complaint states.
According to Lopez, her various back injuries have caused and will continue to cause her pain and suffering, disability, medical expenses, diminution of earning capacity and loss of wages.
Represented by Lance Mallon and Dawna Hale of Wood River, Lopez is seeking damages in excess of $50,000, plus costs of the suit.
The case has been assigned to Circuit Judge Nicholas Byron.
