FELA complaint filed against BNSF

Maintenance of way employee Rickey Stout is seeking in excess of $50,000 from his employer BNSF Railway for injuries sustained to his upper extremities, limbs, neck and back.

According to a Federal Employers' Liability Act suit filed March 10 in St. Clair County Circuit Court, Stout claims he was required to use impact tools including wrenches, track jacks, spike pullers, track wrenches, track chisels, rail saws, anchor wrenches, spike mauls, sledge hammers and tampers.

Stout claims his employer failed to provide him with a reasonably safe place to work and failed to properly train him. Among other things he claims BNSF did not warn him of the danger of exposure to cumulative trauma.

He is represented by Ryan M. Furniss, Steven L. Groves and Gerard B. Schneller of St. Louis.
