Penny Keller filed a medical malpractice suit against Dr. James Dalla Riva and Anderson Hospital in Madison County Circuit Court March 11, alleging she had complications due to Dalla Riva's alleged negligence.Failed to order a bowel prep prior to the surgery;
According to Keller, Dalla Riva was performing an outpatient laparoscopy on April 28, 2006, at Anderson Hospital in Maryville.
Keller claims that during the procedure Dalla Riva committed the following acts or omissions of professional negligence:
Failed to properly identify the anatomy during the surgery prior to cutting;
Failed to recognize he lacerated the intestine;
Allowed her to be discharged after lacerating her intestine;
Failed to recognize he lacerated areas he did not intend to lacerate;
Failed to rule out the use of laparoscopy in favor of laparotomy in light of previous findings; and
Failed to convert to laparotomy in light of her presentation during the laparoscopy.
She claims Dalla Riva's negligence caused her to suffer severe and permanently disabling and disfiguring injuries to her abdomen and internal organs causing her to sustain great pain and mental anguish, lost wages and became liable for large sums of money in hospital and medical treatment.
Keller is represented by Gregory Shevlin of Belleville
Shevlin filed a certificate of merit from Dr. David Burkons of South Euclid, Ohio who states that it is his opinion that this case is reasonable and meritorious.
Keller is seeking damages in excess of $150,000, plus costs.
The case has been assigned to Circuit Judge Nicholas Byron.
