Mother claims driver and bar to blame for daughter's death

A mother whose daughter was killed by an alleged drunk driver filed a wrongful death suit against the man who allegedly ran her over and the tavern who allegedly served him too many alcoholic beverages.

Susan Drayton claims her daughter Mary Drayton died on Nov. 12, 2007, while she was walking south on Missouri Avenue in Granite City.

According to the complaint filed March 10 in Madison County, Myers was allegedly operating his vehicle while intoxicated leaving him in a diminished capacity unable to exercise the highest degree of care at the time he allegedly ran over Mary.

Drayton also claims Myers was negligent by operating his vehicle at a speed greater than reasonable, drove his vehicle without adequate brakes, failed to sound his horn to give a warning to any pedestrians and failed to keep his vehicle within a single traffic lane.

She claims the collision caused Mary to sustain severe and permanent injuries which resulted in her death depriving her parents of her society, companionship, felicity, guidance, advice, training, instruction and all other elements of loss of consortium.

Drayton is seeking damages in excess of $50,000.

She is seeking additional damages from TC's Half Moon Lounge alleging prior to the accident, Myers consumed alcoholic beverages from the tavern which caused him to become intoxicated.

Drayton is represented by Steven Dioneda of St. Louis.
