Laurie Hilliard filed a personal injury suit against Thery Construction Company in Madison County Circuit Court Feb. 28, alleging she was injured while performing work as a subcontractor.
Hilliard claims she is employed for Touch By An Angel Wallpaper & Painting, which Thery contracted with for trim work services at a job site located at 3931 Alliance Dr. in Fosterburg on July 30, 2007.
She claims that while performing the tasks assigned to her, she fell after she encountered a fall hazard at the top of an unfinished stairwell.
According to Hilliard, Thery retained the authority to stop the work to correct unsafe conditions at the job site, but failed to do so which was the proximate cause of her injuries.
Represented by Matthew Chapman of Granite City, Hilliard claims Thery was negligent by failing to make reasonable inspections of the premises and the work being done, failed to provide her a safe place to work, failed to barricade the fall hazard or otherwise remove it, failed to properly manage and control the job site and failed to warn of the fall hazard.
According to Hilliard, she fell several feet which caused permanent and disabling injuries to her head, neck, shoulders, arms, spine, back, legs and feet causing her to suffer physical pain and suffering, medical expenses and lost wages.
She is seeking damages in excess of $100,000, plus costs of the suit.
The case has been assigned to Circuit Judge Dan Stack.
