Torn, wrinkled carpet at Farm Fresh leads to $50k suit

Farm Fresh in Madison

A woman who was allegedly injured after tripping on torn and wrinkled carpet at a Farm Fresh store in Madison filed a personal injury suit Feb. 27 in Madison County Circuit Court.

Cherinza Lucas claims the store, located at 308 Madison Ave., negligently failed to train employees in the correct way to keep wrinkles out of the carpet.

The incident occurred on Aug. 20, 2007.

Lucas, represented by John Hustava of Collinsville, is seeking a judgment in excess of $50,000, but less than $60,000, plus costs.

According to the suit, Lucas also claims the store failed to warn of the wrinkled carpet, used poor judgment in allowing a torn and wrinkled carpet to be used, allowed the carpet to remain in the area for an extended period of time and used poor lighting in the area near the carpet.

She claims the fall caused her to sustain disabling and extensive injuries to her head, back, arms and legs that caused and will continue to cause pain and suffering, lost wages and medical expenses.

The case has been assigned to Circuit Judge Barbara Crowder.
