Charles "Rod" Taylor
Former Madison County bailiff Charles "Rod" Taylor was named as a defendant in a breach of contract suit filed in Madison County Circuit Court Feb. 20.
Plaintiff John Michael Potter alleges Taylor and his wife Shari Ann Taylor borrowed $60,000 on Aug. 30, 2007, and orally agreed to repay the loan amount together with interest which would be compounded annually.
According to Potter, the Taylors agreed to sign a promissory note memorializing the agreement, and further agreed that Rod Taylor would execute a will which would direct his executor to pay off the loan if he died before the debt was paid.
Potter also claims that the Taylors agreed that should they ever sell their home, they would pay off the loan in full at the time of the sale.
"Plaintiff has made demand of the defendants' to execute the promissory note to which they agreed and same has been denied by defendants," the complaint states.
Represented by Ed Unsell of East Alton, Potter is seeking a judgment of $60,000, plus costs, interest and any further relief that is just and equitable.
The case has been assigned to Circuit Judge Andy Matoesian.
