Waterloo home owners sue Royal Pools for breach of contract

Waterloo home owners Howard and Renee Hlina are suing Royal Fiberglass Pools, Inc. and Royal Pools & Patio of O'Fallon for breach of contract and consumer fraud claiming the defendants allegedly failed to complete work on a home swimming pool.

According to a suit filed Feb. 19 in St. Clair County Circuit Court, Royal Pools began installing a pool at the Hlinas home located at 823 Ridge Rd. in June 2004.

The last work on the pool by the defendants occurred in May 2006, the complaint states.

"In or around July of 2004, during the installation of the swimming pool, the swimming pool began to exhibit defects, including concrete problems, surface problems and integrity problems," the complaint states.

The Hlinas claim Royal Pools worked on the problems, but the work was never completed and "Defendants have refused to complete the work on the swimming pool." They also claim their demand for a refund has been denied.

Represented by Timothy A. Gutknecht of Crowder & Scroggins of Columbia, the Hlinas are seeking in excess of $50,000 in compensatory damages and $50,000 in punitive damages, as well as fees and costs.

The Hlinas paid $40,214.79 to Royal Pools for the swimming pool, the complaint states.
