Quarrelsome patrons and Luna Cafe sued for beating up fellow patron

Dana Howard filed a dram shop complaint against the Luna Cafe in Mitchell alleging he was attacked by two patrons at the tavern on Feb. 19, 2007.

Howard claims co-defendants Walter Milton and Kenneth Crawford were also patrons at the Luna Cafe while he was there and that tavern employees gave or sold them too many alcoholic beverages.

According to Howard, Milton and Crawford became "quarrelsome, disorderly and vicious" causing tavern employees to ask them to move a different section of the bar which caused them to sit in close proximity to him.

Howard claims the duo first started to engage in verbal threats towards him, then without provocation, severely beat him in the head and face causing him to sustain serious injuries.

He claims the unprovoked attack left him with fractures to his facial bones which required surgical reduction and implementation of hardware.

Howard also claims he sustained injuries to his teeth and body all of which caused pain and suffering of the body and mind, large sums of medical expenses and lost wages.

Represented by Mark Floyd of St. Louis, Howard is seeking damages in excess of $200,000, plus costs.

The case has been assigned to Circuit Judge Andy Matoesian.
