Wrongful death complaint filed against Cassens

The estate of Mildred Hoots filed a wrongful death suit against Cassens Transport Company and its employee in Madison County Circuit Court Jan. 29, alleging their negligence led to Hootss death.

According to the complaint, Hoots was a resident of Greene County, and was driving her 1999 Mercury Grand Marquee on eastbound exit ramp from Interstate 72 at the intersection of Veterans Parkway in Springfield on Sept. 6, 2006.

Hoots estate alleges a Cassens Transport tractor trailer driven by Lawrence Glastetter failed to obey a red light traffic signal and violently collided with her at the intersection.

The estate claims Glastetter was negligent by driving the tractor trailer at a speed that was greater than was reasonable and proper, with regard to the traffic conditions, failed to keep his vehicle under proper control and failed to adequately inspect or maintain the vehicle.

"The defendant's conduct in operating his tractor trailer evidenced a conscious disregard for safety and the law, and other drivers on the highway," the complaint states.

The estate claims Hootss spouse and children have sustained economic and non-economic damages due to the deprivation of their means of support, society, companionship, guidance, advice and love and affection, plus large sums of money and valuable services Hoots contributed to them.

Hoots' husband, William, a passenger in the car at the time of the accident, claims he sustained serious and permanent injuries that caused lost wages, pain and suffering, emotional distress, medical expenses and a disability and disfigurement.

Represented by Steve Wigginton of Belleville, the estate and William Hoots are seeking damages in excess of $300,000, plus costs of the suit.

The case has been assigned to Circuit Judge David Hylla,
