Lou A. Jethro filed a Federal Employers' Liability Act suit against Kansas City Southern Railway Co. claiming he was subjected to numerous repetitive traumas over the course of his career as a switchman from 1976 through 2007.
According to the complaint filed Jan. 18 in St. Clair County Circuit Court, Jethro's injuries came from throwing defective switches, tripping over debris in the yard, tripping in potholes obscured by poor lighting and stumbling over tie-butts and overgrowth.
Represented by Gregory M. Tobin of Pratt & Tobin in East Alton, Jethro is seeking in excess of $50,000 in damages.
He claims the defendant is negligent for failing to provide a safe place to work, failing to provide safe methods of work, failing to provide sufficient manpower, and failing to provide safe tools and equipment.
