The Cellar Room in Alton
Shawn Avery filed a Dram Shop complaint against The Cellar Room in Madison County Circuit Court Jan. 11, alleging the Alton tavern is liable for the injuries he received in a car accident.
Avery alleges the Cellar Room served alcoholic beverages to Tracy Nailor on Jan. 15, 2007, causing him to become intoxicated.
According to Avery, while intoxicated, Nailor collided with him on Broadway Street in Alton causing Avery to sustain severe and permanent injuries, pain and suffering and lost wages.
Avery's wife, Sonja, also is seeking damages under the Illinois Family Expense Act alleging she became liable for all expenses incurred as a result of her husband's injuries.
She also alleges she has suffered a loss of means of support as a result of her husband's inability to work due to his various injuries.
Represented by Chris Donohoo of Wood River, the Averys are seeking damages in excess of $200,000, plus costs of the suit.
The case has been assigned to Circuit Judge Andy Matoesian.
