Bite victim was warned about dog's behavior, defendant says

A woman who filed suit over a dog bite had been warned of the dog's behavior before she decided to pet the dog, claims the defendant in a Madison County personal injury case.

Represented by Michael Kokal of Heyl Royster in Edwardsville, defendant Lisa Guilliams argues that plaintiff Cheryl Perigan's own contributory negligence was the cause of the dog bite.

According to the suit filed Sept. 19, Perigan claims she was at Guilliams' residence at 4033 Sarah in Granite City on July 6, when without provocation, she was bitten by a dog Guilliams owned.

Perigan claims she sustained various injuries to parts of her body all of which has and in the future will cause pain, permanent disability and disfigurement.

She also claims that she has and will continue to become obligated to spend money for medical treatment in an attempt to treat her various injures.

Perigan is seeking damages in excess of $50,000, claiming Guilliams violated the Animal Control Act.

Guilliams argues that Perigan is not entitled to relief under the Animal Control Act and further argues that Perigan failed to mitigate her damages.

She is asking Circuit Judge Barbara Crowder to reduce Perigan's award, if any, to reflect her own negligence.

Perigan is represented by Brad Badgley in Belleville.
