A woman who was injured when the car she a passenger in was involved in an accident filed suit against the drivers of both vehicles in Madison County Circuit Court Aug. 15.
Lindsay Wilken claims she was a passenger in a 2005 Chevrolet Equinox driven by defendant Shawn Wilken on Aug. 21, 2005. Wilken's vehicle was traveling northbound on Interstate 55 near exit 30 in Madison County.
She claims co-defendant Brian Wiegemann was driving a 2002 Honda motorcycle and was driving behind the vehicle driven by Shawn.
Wilken claims Wiegemann attempted to pass them when his motorcycle struck the back of the Equinox causing it to leave the roadway and roll over ejecting her from the car.
According to Wilken, both Wiegemann and Shawn Wilken negligently failed to keep a proper lookout, drove at a speed that was not proper, failed to decrease their speed to avoid a collision, and operated their vehicles in a reckless manner with a willful and wanton disregard for the safety of people and property.
Wilken claims the collision caused her to sustain severe and permanent injuries that caused pain and anguish, medical expenses, disability and lost wages.
Represented by John Milhiser of Springfield, Wilken is seeking damages in excess of $100,000, plus costs.
