Alton Square Mall escalator leads to man's hip injury, suit says

James Foster filed a personal injury suit against Alton Square Mall in Madison County Circuit Court July 30, seeking damages for injuries he received after falling on an escalator April 20.

According to Foster, Alton Square negligently and carelessly failed to properly inspect the escalator and handrail for defects.

He also claims the mall failed to warn him of the conditions of the escalator and failed to maintain the escalator and handrail in good working order.

Foster claims the fall on the escalator caused injuries to his hip that caused and will continue to cause pain and suffering, medical expenses, loss of wages, disability and a diminution of his earning capacity.

Represented by Lance Mallon and Dawna Hale of the Mallon Law Firm in Wood River, Foster is seeking damages in excess of $50,000, plus costs of the suit.

The case has been assigned to Circuit Judge David Hylla.
