Unsecured wall stud causes carpenter's injuries, suit says

Marvin Horn filed a personal injury suit against P&A Drywall Supply and D&D Construction in St. Clair County Circuit Court June 19.

According to the complaint, Horn was employed as a carpenter for D&D, who was the general contractor on a residential construction project in Highland.

P&A was hired to supply drywall for the project.

Represented by Bruce Cook of Belleville, Horn claims on May 5, 2006, employees of P&A removed a wall stud which had been nailed in place to allow the drywall to fit through the hallway.

He claims when they returned the stud to its former position, they allegedly neglected to nail it in place.

Horn claims he became injured when he leaned the ladder against the wall stud and it dislodged from the wall causing him to fall to the ground.

Horn claims P&A negligently removed a wall stud which was nailed in and replaced it without using nails and failed to warn him of what they did.

He claims D&D negligently and carelessly failed to provide him a safe place to work and negligently failed to warn him that a wall stud had been removed and not nailed back in place.

According to Horn, he sustained severe and permanent injuries to his left knee and his left hand, lost wages, incurred medical expenses and experienced pain and suffering.

He is seeking damages in excess of $100,000, plus costs of the suit
