345 Jubaka
Larry Mundy is suing Chateau Plaza Inc., St. Clair County and the city of Fairview Heights for injuries he sustained last year after tripping on a wire that upheld a tree in a parking lot.
Seeking in excess of $150,000 in damages, Mundy claims the parking lot at 345 Jubaka in Fairview Heights was unsafe for walking.
"On July 8, 2006, at nighttime, plaintiff Larry Mundy, an invitee, was attempting to walk to his vehicle when plaintiff tripped on said parking lot on one of the wires holding a tree upright causing plaintiff to fall and injure himself," states the complaint filed June 20 in St. Clair County Circuit Court.
Mundy is represented by Benjamin F. Goldenhersh of Goldenhersh & Goldenhersh in Belleville.
He claims he has suffered a loss of a normal life, disfigurement, pain and suffering, medical expenses and lost wages or earnings.
He also claims that at the time of the incident the defendants had actual or constructive notice of the dangerous condition and had ample time to remedy and repair the condition.
