Danny Shurtz filed suit against Teleflex Inc. in Madison County Circuit Court May 15, alleging his photograph was used in a catalog without his permission.
Shurtz claims his likeness and identity have been featured pictorially in Teleflex catalogs and brochures without having previous written consent from him.
According to the complaint, Teleflex manufactures and sells emergency medical equipment and supplies.
Shurtz claims Teleflex has benefited commercially from illegally using his identity and claims he has suffered "irreparable harm, shame, embarrassment, ridicule, and a loss of reputation within his field of employment."
Represented by Thomas Schooley of Granite City, Shurtz is seeking damages in excess of $50,000, plus costs.
The case has been assigned to Circuit Judge Daniel Stack.
