Trucking firm sues customer over unpaid fuel surcharge

A Metro-East trucking company is suing a customer for not paying for its increased fuel costs.

Beelman Truck Co. filed suit against Troy Ready Mix Concrete on May 4 in St. Clair County Circuit Court for damages in excess of $50,000.

According to the complaint, the businesses had an agreement whereby either party had the right to renegotiate rates in the event of a sudden -- at least 25 percent in a three-month period --increase in the cost of fuel.

The suit claims that Troy Ready Mix Concrete has breached contract from July 28, 2006, to present by failing to pay a fuel surcharge and by adjusting rates downward.

"The plaintiff has continued to honor its duties and obligations under the Transportation Agreement, performing the services requested and submitting its invoices in accordance with the Transportation Agreement," the complaint states.
