Gerald Copeland of Belleville alleges he sustained knee and wrist injuries after falling on a clear hot dog machine lid left in the aisle of an East St. Louis convenience store.
According to a personal injury lawsuit filed April 17 in St. Clair County Circuit Court, the incident took place at the Crown Food Mart located at 8301 State St. on April 3.
Copeland, represented by Bruce R. Cook of Cook, Ysursa, Bartholomew, Brauer & Shevlin of Belleville, is seeking in excess of $50,000 in damages.
He claims that the defendant, Kings Food Phillips of IL, Inc., was negligent for failing to maintain its premises in a reasonably clean condition by allowing a clear lid to the hot dog machine to be placed on the floor where customers would be walking. He also claims the store was negligent for failing to periodically inspect the floor and for failing to warn customers of the presence of the clear lid.
