Attorney Amanda Verett, having settled a crash suit with the other driver's insurer for $50,000, wants $50,000 more from her own insurer.
Verett's attorney, Thomas Maag, dismissed Tracey Zobrist as defendant in a 2005 crash and sued Safeco Insurance.
Maag wrote, "Safeco owes Verett $50,000."
Verett sued Zobrist last year, claiming she suffered injuries when Zobrist's car struck the rear of her car in Edwardsville.
On April 11, Maag told Madison County Circuit Judge Barbara Crowder that Verett and Zobrist settled.
Maag moved to dismiss Zobrist and amend the complaint.
Crowder granted the motions.
Maag's new complaint against Safeco stated that the fair and reasonable value of Verett's claim exceeded $100,000.
Maag wrote that Zobrist's insurer paid the policy limit of $50,000.
He wrote that Safeco approved the settlement.
He wrote, "…there remains a remaining $50,000 of underinsured motorist coverage available to plaintiff from Safeco."
In a second count he claimed Safeco violated the Illinois Insurance Code.
In addition to $50,000, he asked for interest, attorney fees, costs and a 25 percent penalty.
